By accessing or using Lodgic ("the Service"), available at lodgic.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Lodgic ("we," "us," or "our"). By creating an account, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.
Lodgic is a property management and bookkeeping software-as-a-service (SaaS) platform designed for short-term rental (STR) hosts. The Service provides tools for bookkeeping, property management, receipt scanning, tax reporting (including Schedule E and 1099 generation), CSV data import, and reservation management. The Service may integrate with third-party services including, but not limited to, Stripe for payment processing, Hospitable for reservation synchronization, and AI-powered tools for receipt scanning and data analysis.
Lodgic is not a certified public accounting firm, tax advisor, or legal advisor. The Service is a tool to assist with bookkeeping and record-keeping. You are solely responsible for the accuracy of your financial records and tax filings. You should consult with a qualified tax professional or accountant before making financial or tax decisions.
You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized use of your account. You are responsible for all activities that occur under your account, whether or not you authorized them. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.
If you create an account on behalf of a company or organization, you represent and warrant that you have authority to bind that entity to these Terms, and "you" and "your" shall refer to that entity.
You agree not to use the Service to:
We reserve the right to investigate and take appropriate action, including suspending or terminating your account, for violations of this section.
You retain all rights, title, and interest in your data, including financial records, transaction data, receipt images, property information, and any other content you upload to the Service ("Your Data"). We do not claim ownership over Your Data. By using the Service, you grant us a limited, non-exclusive license to use, process, and store Your Data solely for the purpose of providing and improving the Service.
You may export or request a copy of Your Data at any time. Upon account termination, we will retain Your Data for a reasonable period (not exceeding 90 days) to allow for retrieval, after which it will be permanently deleted unless legally required to retain it.
Lodgic offers subscription plans including Free, Starter, Growth, and Business tiers. Paid subscriptions are billed on a monthly or annual basis. All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge the payment method on file for recurring subscription fees.
Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period. You will not be charged for subsequent billing periods after cancellation.
Refunds: We do not offer refunds for partial billing periods. If you believe you have been charged in error, please contact us at legal@lodgicapp.com within 30 days of the charge.
Price Changes: We may change subscription pricing with at least 30 days' notice. Continued use of the Service after the price change constitutes acceptance of the new pricing.
The Service, including its design, code, features, logos, and documentation, is owned by Lodgic and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service, except for the limited right to use it in accordance with these Terms. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LODGIC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
Lodgic is not liable for any errors, inaccuracies, or omissions in tax reports, financial summaries, or AI-generated outputs produced by the Service. You acknowledge that the Service is a tool to assist with bookkeeping and that you are solely responsible for verifying the accuracy of all outputs.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not guarantee the accuracy of AI-powered features such as receipt scanning and CSV analysis. These features use third-party AI models and may produce errors. You should always review and verify AI-generated results.
You may terminate your account at any time by contacting us or through your account settings. We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including, without limitation, Data Ownership, Limitation of Liability, Disclaimer of Warranties, and Dispute Resolution) shall survive.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by a mutually agreed-upon arbitration provider, rather than in court. Arbitration shall be conducted on an individual basis; class actions and class arbitrations are not permitted.
Before initiating arbitration, you agree to first contact us at legal@lodgicapp.com and attempt to resolve the dispute informally for at least 30 days. If the dispute cannot be resolved informally, either party may initiate binding arbitration.
Small Claims Exception: Either party may bring qualifying claims in small claims court.
These Terms shall be governed by and construed in accordance with the laws of the State of [STATE], United States, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration shall be brought in the state or federal courts located in [STATE/COUNTY].
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Effective Date" above. For significant changes, we will make reasonable efforts to notify you via in-app notification. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
